Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and [Cream Technologies, Inc.] (“cream,” “we,” “us”). By creating an account or using the cream desktop app, command-line tool, website, or rewards program (together, the “Service”), you agree to these Terms and to our Privacy Policy.

If you are using cream for an organization, you represent that you are authorized to accept these Terms on its behalf.

cream is an agentic coding environment that plans, writes, and refines code with you. It works fully with or without the optional rewards program. We may add, change, or remove features over time, and we will give reasonable notice of significant changes that affect you.

You must be at least 16 years old, or the age of majority where you live, to use cream. You are responsible for your account, for keeping your credentials secure, and for all activity under your account.

Tell us promptly at support@cream.dev if you suspect unauthorized use.

cream connects to large language models through OpenRouter and the model providers behind the top models in the app. Your use of those models is also subject to OpenRouter’s and each provider’s terms and acceptable-use policies, which you agree to follow.

If you bring your own API keys, you are responsible for your accounts, any fees those providers charge, and compliance with their terms. cream is not responsible for third-party services, their availability, or their output.

You agree not to use cream to:

• Break the law, infringe others’ rights, or violate a third-party model provider’s policies.
• Build malware, conduct attacks, or attempt to disrupt or reverse-engineer the Service.
• Game the rewards program through fraud, automation, or fake activity.
• Resell or sublicense the Service without our written permission.

Ads and earning are on by default in the cream desktop app: sponsor creative is shown between turns, and you accrue moo'lah for genuine coding activity, subject to program rules. You can turn ads and earning off at any time in Settings, which stops both the sponsor creative and any further accrual. (The cream CLI is the exception: its sponsor rail stays off until you run cream ads on.)

Moo'lah is an in-app score, not money: it has no cash value, there is no payout, and it cannot be exchanged for cash. Moo'lah only accrues for genuine activity; we may withhold, reverse, or forfeit moo'lah tied to fraud or abuse. We may change, suspend, or end the program, and we will give reasonable notice where balances you have already accrued are affected.

Ads are on by default in the desktop app and can be switched off at any time in Settings. Rewarded video is separate and always your choice: it only plays when you start it. There are no ads in your code, your terminal output, or the AI's answers, and ad controls live entirely in Settings. We are not responsible for the products or claims of sponsors, and showing a sponsor’s creative is not an endorsement.

Your code is yours. You keep all rights to the code, prompts, and projects you create with cream. We claim no ownership over your work and do not use it to train models.

cream, its software, brand, and design system are owned by us and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service under these Terms; all rights not granted are reserved.

cream uses AI models that can be wrong, incomplete, or insecure. Generated code and suggestions are provided as-is and may produce similar results for other users. You are responsible for reviewing, testing, and securing any code before you use it.

You are responsible for ensuring your use of generated output complies with applicable licenses and laws.

Some features may be free and others paid. Where fees apply, we will show pricing before you buy. Paid amounts are non-refundable except where required by law or stated otherwise. Model-provider charges from your own keys are billed by those providers, not by cream.

You may stop using cream and close your account at any time. We may suspend or end your access if you breach these Terms, create risk for the Service or others, or as required by law. Provisions that by their nature should survive, including ownership, disclaimers, and limitation of liability, survive termination.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE OR ANY AI OUTPUT WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

TO THE FULLEST EXTENT PERMITTED BY LAW, CREAM WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR [USD 100].

You agree to defend and indemnify cream against claims, damages, and costs arising from your use of the Service, your content or code, or your breach of these Terms or of a third-party provider’s policies.

These Terms are governed by the laws of [the State of Delaware, USA], without regard to conflict-of-law rules. Disputes will be resolved in the courts located in [that jurisdiction], unless a binding arbitration or different venue is agreed in writing. Nothing here limits rights you have under mandatory local consumer law.

We may update these Terms as cream evolves. When changes are material, we will update the date above and notify you in the app or by email. Continued use after an update means you accept the revised Terms.
